TERMS & CONDITIONS (Please read carefully)

1 – Agreement In making a booking and paying the booking fee to Horizon Charters Ltd the Hirer agrees to be bound by the complete terms and conditions of Horizon Charters Ltd as detailed herein.
2 – Payment A non-refundable booking fee of $ 400 is required to confirm a booking. All enquiries are unreserved until the booking fee has been paid and confirmation sent in writing. Balance of Charter fee is to be paid in full 10 working days prior to commencement of charter. Failure to pay balance by due date will result in cancellation of booking and forfeit of booking fee. A refundable bond of $500 is to be paid in addition to the charter fee, this will be refunded on completion of the scheduled charter, subject to clause 10.
3 - Cancellation by Hirer Full refund of Charter fee paid (less booking fee) will be given provided notice of cancellation is received no later than 48hrs prior to booked charter commencement. 50% refund of Charter fee paid (less booking fee) will be given if notice of cancellation is received between 24hrs & 48hrs prior to booked charter commencement. No refund will be given if notice of cancellation is received less than 24hrs prior to booked charter commencement. Where a catering fee has been paid, ownership of catering provisions will remain with the Hirer and can be picked up from Horizon Charters Limited nominated location.
4 - Cancellation or Alteration by Horizon Charters Ltd Horizon Charters Ltd reserves the right to cancel, reschedule or modify any confirmed booking at any time. Cancellations made by Horizon Charters Ltd up to the time of scheduled charter departure, will at the Hirers discretion, be rescheduled or refunded (any refunds will be less booking fee paid). If the scheduled charter is shortened by Horizon Charters Ltd, any Whole Days of scheduled charter not used will be refunded (except where cause of shortening is due to misconduct by the Hirer, in which case no refund will be made). If the intended route of the scheduled charter is changed by Horizon Charters Ltd no refund of charter fee will be made. If the scheduled charter is shortened by Horizon Charters Ltd at the request of the Hirer, no refund will be made.
5 - Refunds & Transfer of Fees Paid Refunds will be made generally as allowed for in the various sections of these Terms & Conditions. The booking fee can be transferred to an alternative booking by the Hirer if notice of cancellation is received by Horizon Charters Ltd no later than 48hrs prior to booked charter commencement. All Charter fees valid for refund can be transferred to an alternative Charter without incurring fees.
6 - Correspondence The Hirer must receive written confirmation from Horizon Charters within stated times for bookings, cancellations and/or transfers. Horizon Charters Ltd takes no responsibility for late notification due to any correspondence system failure that causes delay in receiving any instruction or notice from the Hirer.
7 – Authority Whilst under charter, absolute authority for the vessel and passengers/crew is with the Horizon Charters Ltd Skipper. Horizon Charter Ltd reserves the right to cancel, shorten and/or modify in any way, any charter if they perceive there exists an unacceptable risk to the safety of passengers/crew and/or vessel for what ever reason. Horizon Charters Ltd Skipper’s decision is final.
8 - Definition of Times Scheduled charters will nominally commence at 0800hrs on the first day of scheduled charter and nominally finish at 1700hrs on the last day of scheduled charter unless confirmed otherwise by Horizon Charters Ltd in writing. Unless on the first day and/or last day of scheduled charter, a Whole Day will be considered the 24hr period starting from midnight.
9 - Liability Wavier The Hirer acknowledges that travelling on the sea has inherent hazards and risks. The Hire will not hold Horizon Charters Ltd or any of its employees or agents liable for any event or situation before, during or after the Hirer’s scheduled charter. As part of any normal holiday activity, Horizon Charters Limited recommends the Hirer take out their own travel insurance to provide financial cover for unforeseen circumstances that may arise before or during the scheduled charter.
10 - Hirer to Indemnify Damage and/or Fines The Hirer agrees to reimburse Horizon Charters Ltd and their employees and/or agents the full amount of any cost/expense Horizon Charters Ltd incurs through negligent and/or unlawful action of the Hirer.
Any accidental damage caused by the Hirer but covered by Horizon Charter Limited insurance, will have insurance excess amounts deducted from the bond. Where insurance excess is more than the bond amount in such instances, the Hirer will be liable to pay the difference.
11 - Alteration to Term & Conditions Horizon Charters Ltd reserves the right to alter these terms and conditions at any time without notice.
